Singapore Woman Contemplates Legal Dissociation from Parents Due to Mental Health Struggles

A woman in Singapore recently took to social media seeking advice on legally severing ties with her parents, citing the impact of her declining mental health. The unidentified woman, in a post on the r/askSingapore subreddit on Sunday (Jan 28), expressed her intention to “legally break relationships with her parents” and inquired about the process, legal involvement, and associated fees.

Seeking both legal and practical guidance, she refrained from disclosing details of the issues within the familial relationship but indicated that this decision was not impulsive. The woman also sought recommendations from the Reddit community regarding a suitable place to stay after breaking ties with her parents, even mentioning difficulties experienced when sleeping on the streets.

Concerned members of the Reddit community responded with support and advice, suggesting that she should consider simply moving away from her parents and discontinuing communication. Comments urged her to focus on building her life, with one Reddit user stating, “No legal thing to involve. Just move out and cut off contact lor,” while another advised, “Just move out, or better yet, move overseas. Focus on building your life.”

Amid the responses, one user provided comprehensive guidance on the situation, emphasizing that there were no legalities involved except for the Maintenance of Parents Act (MPA). This individual advised the woman to move away and cut off contact while detailing the potential legal avenues available.

The commenter explained that, under the MPA in Singapore, elderly or in-need parents aged 60 and above have a legal avenue to request maintenance from their children if they cannot provide for themselves. Individuals under 60 can also apply if they have a special need for maintenance or suffer from an infirmity of mind or body.

Furthermore, the commenter outlined options for accommodation, including HDB low-income housing, homeless shelters, co-living spaces, and traditional rental options.

However, the legal process under the MPA involves a thorough review of the financial needs, disabilities, earning capacity, and spending habits of the parents, as well as an examination of the child’s earnings, contributions, and provisions for the parent’s maintenance.

The Tribunal for Maintenance of Parents (TMP) may reject an application if it deems it frivolous or vexatious, meaning there are insufficient grounds or if the application was made to cause distress to the child. This insight was provided in accordance with Section 14(7)(a) of the MPA.
